The Fort Hood Murder Suspect has a Day in CourtThe Fort Hood murder suspect who killed thirteen people in his shooting rampage has a scheduled one of many court hearings today. This is not the trial but it is necessary under Army protocol of the article 32 investigation. This hearing was no more than a prepatory meeting between the defense attorney and the prosecuting attorney. Major Nidal has the right to be present at any hearing which concerns his case.

In this hearing a judge looks at the evidence and decides whether this case needs to go to trial, which is pretty much a no brainer. We can also assume that the prosecuting attorney will seek the death penalty is this case. That’s a no brainer also.

The defense is doing his job well also. The defending attorney had requested that this hearing be delayed claiming that he needs more time. All of these things are just procedure in each case. The real trial will get started after all of the legal pieces are worked out. Each side of the Judge Advocate General’s ring customers will insure that all of the i’s are dotted and all of the t’s are crossed to prevent a mistake from ruining the case.
